As seen on Season 23 of Oxyen's Snapped, Ashley drugged her husband, Greg Schutt and then proceded to kill him using a hammer and knife. She claimed three men entered the house, raped her and killed her husband. She was convicted and found guilty of malice murder, aggravated assault for slitting her
husband’s throat, possession of a knife during the commission of a crime
and false statements. In all, she was sentenced to life for murder plus an additional 20 years for
aggravated assault and another 15 years for the remaining charges.
She appealed the verdict based on the evidence was insufficient to support her conviction for aggravated assault, that the aggravated assault should have been “merged” with her murder conviction for sentencing purposes because the same evidence was used to prove each crime, that her trial attorney was incompetent and ineffective, and that the trial court erred by failing to suppress her statements to police. Her appeal was denied and her sentence upheld.
Her appeal (see link) includes:
The evidence at trial, viewed in the light most favorable to theverdict, showed the following. On July 25, 2009, Appellantarrived home fromworkshortly after 1:00 a.m. and prepared her husband a late dinner that shelaced with prescriptionsleep medicine. Afterher husband fell asleep in the master bedroom, Appellant attacked him, beating him repeatedly with a ball-peen hammer and stabbing him 38 times in the face, chest, sides, back, abdomen, and left thigh. The victim’s throat and wrists were also cut. The medical examiner determined that the cause of death was the combined effect of stab wounds to the torso and thigh and blunt force trauma to the head.Appellantwas alone in the house with the deceased victim for severalhours. Duringthat time, she washed the hammer and two knives in thebathroomsink, attempted to clean upthe blood, ripped a picture ofher and the victim in two and threw the pieces onthe floor next to her and her husband’s wedding rings, used scissors to cut up a pair of her shorts and a bra, and cut herself superficially in the arma few times with a knife.
According to AJC, Schutt testified Wednesday that she didn't plan to kill her husband the night of July 25, 2009. She was planning to divorce him to end a marriage she said had become frightfully abusive. Schutt, whose murder trial in Gwinnett County began April 25, testified that Greg Schutt started screaming at her for leaving the stove on at their house in Lawrenceville when she went outside to walk their dog. She feared the 6-foot-5-inch-tall man who weighed 269 pounds was about to beat her, like she claimed he had done so many times before.
